This site is named Free Deltan as a preemptive measure. We hope to raise his profile internationally so that there will be pressure, on the corrupt Brazilian government, to keep him free. In the tradition of the patron saint of lawyers, Thomas More, Deltan speaks truth to power and follows God’s will, as he is able to discern it, rather than succumb to the temptation of terrestrial threats.

Lawyer Leandro Rosa, representing Deltan, said that the deputy was able to run in the elections and that the TCU’s decision against him was suspended by an injunction from the Federal Court in Curitiba.

The lawyer also stated that the ex-prosecutor’s request for dismissal was made after the CNMP provided a certificate confirming that there were no ongoing proceedings against him.

The defense confirmed that the former prosecutor received a warning and censure by the council, but the sentences were served and the proceedings closed.

This week, President Lula, in his videocast entitled “Conversation with the President”, once again attacked Lava Jato. The attack began like this: “I was always a person who had the deepest respect for the Public Ministry. It was one of the institutions that I most idolized in this country. After that gang that Dallagnol set up, I lost a lot of confidence.”

Thus, the Public Ministry was idolized by Lula while investigating the corruption of others, but became an executioner when investigating him and his allies. This explains the revenge promoted in the Lula government against those who worked in Lava Jato.

By referring to the Lava Jato task force as a gang, Lula tries to isolate the Lava Jato work in a small group of people, when it was the work of more than forty members of the Public Ministry, dozens of police officers, auditors, analysts, technicians , judges and ministers.

It is worth remembering that Lula was convicted in the first case by Moro and in the second by Judge Gabriela Hardt; that his first conviction was unanimously upheld in court by a panel of three judges and, in the second action, by the same panel after its change, with the replacement of one of its members; and that his first conviction was maintained in the STJ by four ministers.

In each of these instances, members of the Public Prosecutor’s Office defended Lula’s conviction for crimes of corruption and money laundering that amounted to tens of millions of reais. Lava Jato was a great institutional project.

Thus, Lula attacks democratic institutions. For much less, there are people being investigated by the STF and arrested. As this is a crime related to presidential functions, which is not covered by presidential immunity, Minister Alexandre de Moraes has certainly already ordered the initiation of an inquiry.

Irony aside, it doesn’t worry me that the Public Ministry has lost Lula’s trust. I would worry if it was the other way around. Take a good look at who Lula has confidence in: more than a third of Lula’s ministers have already been investigated or have been under accusations. Lula trusts people like José Dirceu, convicted in Mensalão and Lava Jato.

Lula’s attack on Lava Jato continued in a high tone: “I lost [trust in the Public Ministry] because it’s a bunch of crazy people who thought they could take power. They were attacking everyone at the same time, attacking the Government, attacking the Executive branch, attacking the Legislative branch, attacking the Supreme Court, attacking everyone.”

In his juggling, Lula reverses the game: it is not corruption that attacks institutions. Nor is it his attack on law enforcement that erodes institutions. What undermines institutions, you see, is the fight against corruption. Everything seems inverted in Brazil.

However, perhaps there is some truth there: the institutional system has become so rotten, so corrupt, that it has become impossible to investigate and punish corruption in Brazil without reaching a large number of powerful people. On the other hand, Lula is wrong to assume that this is an attack on institutions. On the contrary, it is a defense of institutions against those who co-opted them to commit crimes.

In Lula’s reading, still, Lava Jato reached not only the government and Congress, but was reaching the STF. I would like to better understand the president’s view: could it be that, for him, this was a fundamental factor for the Supreme Court, which was previously “cowardly”, in Lula’s own words, to change its view of the investigation?

Lula ended his attack this way: “They [Dallagnol and his gang] held Brazilian society hostage for a long time.”

Here I have to partially agree with Lula: Brazilian society was really hostage to a gang for a long time. However, it is not Lava Jato that was held hostage, but those who looted Petrobras and Brazil for decades, these indeed, in fact, proven to be a gang.

The truth is that the operation revealed a sea of ​​mud that was under the rugs of power, and showed the Brazilian people that corruption is not fatal, but a criminal practice that can and must be fought.

Lula’s speech is not surprising, after all, about Lava Jato, Lula, as one of the main convicts in the investigations, he could not speak the truth. Therefore, he continues trying to create the narrative that his crimes did not occur, based on the annulment-and not acquittal-performed by the STF.

Instead of facing the situation with humility and admitting his mistakes, Lula prefers to attack Lava Jato and its team. In his government, law enforcement agents are persecuted, paying today for the successes of the operation, and not for possible mistakes. The great crime of Lava Jato was, frankly speaking, to disturb those who are in charge of the political game in the country. What we need to do is turn this game around.

After TSE annuls Dallagnol’s mandate, opposition rescues CPI from Abuse of Authority

With the cancellation of the mandate of Deltan Dallagnol (Podemos-PR) in the Chamber by the Superior Electoral Court (TSE) and the recent operations against former president Jair Bolsonaro (PL) and his allies, the opposition to the Lula government in Congress has been working to create the Parliamentary Commission of Inquiry (CPI) on Abuse of Authority.

The idea resurrects an application submitted by federal deputy Marcel Van Hattem (Novo-RS) in November last year.

Novo created a specific website about the CPI. The party claims that the commission will investigate the abuses of the Judiciary – and specifically cites the TSE and the Federal Supreme Court (STF). According to the website, at 4:05 pm this Sunday, the 21st, around 396,700 people had joined a petition.

Still according to party calculations, 144 deputies have already signed the request. To be installed, a CPI needs to be requested by at least one third of the Chamber, that is, 171 parliamentarians.

“For order to prevail in a country, people need to trust that the judiciary is capable of delivering justice. The impeachment of Deputy Deltan Dallagnol by the TSE shows that members of the highest courts in the country have long since abandoned this objective”, says a text published on the Novo party website.

Deltan’s mandate was annulled on Tuesday, the 16th, by the TSE based on the Clean Record Law. The ministers of the electoral court unanimously understood that the former Lava Jato prosecutor requested dismissal from the Federal Public Ministry (MPF) in 2021 – about 11 months before the 2022 elections – to get rid of internal processes that could make him it ineligible. Dallagnol responded at the time to administrative complaints and unions.

To Estadão , Deltan stated that he will appeal ‘until the end’ to maintain his mandate in the Chamber. He also said that the TSE decision was rigged: “Did I steal, corrupt, abuse, torture? No”.
